Uber Lyft will let customers take sexual assault claims to court

Fourteen women are attempting to sue Uber over sexual assaults and harassment they faced from drivers.

Previously, passengers agreed to arbitration when they signed up for Uber, as part of its terms of service. Khosrowshahi has vowed to "do the right thing", fix the damage from previous missteps and lure back alienated riders who defected to rivals such as Lyft. Several of those drivers have been convicted, and multiple cases are pending. "It is not something we will be able to solve on our own."On Tuesday, following Uber's announcement, Lyft said it would work with Uber to release comparable data". CNN's analysis came from an in-depth review of police reports, federal court records and county court databases for 20 major USA cities. "So moving forward, survivors will be free to choose to resolve their individual claims in the venue they prefer: in a mediation where they can choose confidentiality; in arbitration, where they can choose to maintain their privacy while pursuing their case; or in open court. This policy extends to passengers, drivers and Lyft employees". Uber is also doing away with the mandate that all settlements concerning sexual assault or harassment must be kept confidential.

The changes concerning misconduct have come a month after Uber announced that it will carry out criminal background checks on its USA drivers annually and add a 911 button for summoning assistance in case of emergencies; an effort to keep people from using its service to prey on possible victims. "We think it is very, very important to allow survivors of sexual assault and sexual harassment the control and agency that was, frankly, stripped from them in that incident", Uber's chief legal officer, Tony West, told CNN in a phone interview. For example, Houser said riders may now be more emboldened to report inappropriate behavior, such as when a driver asks them out for a date. The absence of openness about the variety of events committed by motorists has actually been a sticking point by victims in suits, which declare Uber aims to hide the true scope of the issue from its consumers. Even so, the company says it "agree [s] with the changes" and isn't shy about following its rival's lead in most respects. 4 cops departments- Austin, Boston, Denver and Los Angeles- tracked criminal activities including rideshare motorists and shared their information on sexual assault problems. And in the midst of the #MeToo movement, advocates have singled out these stipulations as tools used to stifle women's stories of sexual harassment and assault. Uber is shifting its stance after receiving an open letter from the NY law firm Wigdor LLP, which already has filed a lawsuit seeking to be certified as a class action representing women who allege they have been raped, sexually harassed or abused in other ways by Uber drivers.
