(GRU is Russia's military intelligence organization.) So according to van der Zwaan, Gates talked openly about Person A's ties to Russian intelligence. And van der Zwaan, all along, had grown far too close to the trio.
He also says he's anxious he'll miss the birth of his first child, which is due in August.
Fourth, the lies and withholding of documents were material to the Special Counsel's Office's investigation.
Van der Zwaan's legal team asked the court on Tuesday for no jail time arguing that though he has not been incarcerated since he pleaded guilty in November: "Alex has in many ways been serving a sentence while stuck in limbo..."
"His career has been destroyed, he has been separated from his friends and family, and he faces the possibility of missing the birth of his first child".
"Although Alex committed a serious offense, just punishment does not require incarceration", the filing states. Van der Zwaan is the son-in-law of German Khan, a Russian bank owner who is suing BuzzFeed News over the publication of an unverified dossier of information concerning President Donald Trump.
Van der Zwaan pleaded guilty last month to one count of making false statements to investigators in the Russian Federation investigation, which is examining the extent of Russia's interference in the 2016 election and whether members of the Trump campaign colluded with Moscow to sway the race in Trump's favor. After van der Zwaan pleaded guilty to false statements on February 20, Kilimnik declined to comment on whether he was Person A. He helped produce a report that Skadden wrote in 2012 that largely defended the prosecution and conviction of the country's former prime minister, Yulia Tymoshenko. Gates spent a decade working for Paul Manafort, the indicted former Trump campaign chairman, as a political consultant in Ukraine. Van der Zwaan had recorded those calls, but in his first meeting with investigators, represented by a Skadden partner, he failed to tell investigators about the recordings, according to the filings.
Gates has agreed to work with the special counsel.
Van der Zwaan got caught, faced charges for it, pled guilty, and is now awaiting sentencing in federal court in Washington. The judge required him to stay in the Washington metropolitan area until his next court date, although he's been allowed to travel to Manhattan to meet with his lawyers if he gives advance notice to the Pretrial Services Agency. At the time he was a lawyer with the firm Skadden, Arps, Slate, Meagher & Flom; Skadden later fired him. Federal Bureau of Investigation Special Agents assisting the Special Counsel's Office assess that Person A has ties to Russian intelligence service and had such ties in 2016.
New documents in the Russia probe show that former Trump campaign manager, Paul Manafort, and his aide, Rick Gates, had contact with a business associate with known Russian intelligence ties, the Guardian reports.
Had Trump-Russia believers read Mueller's memo more carefully, they might have noticed it specifically states that the conversations between "Person A", van der Zwaan and Gates "concerned potential criminal charges in Ukraine" about a report concerning the corruption trial of a former government official and the compensation Gates and Manafort were paid for their lobbying work, rather than anything pertaining to the Trump campaign or the U.S. presidential election.
Could this new revelation lead the Special Counsel down the road to collusion? This individual is also described as being "pertinent to the investigation".
It added that federal investigators had assessed that Person A is directly tied to Russian intelligence "and had such ties in 2016".
Manafort - who is fighting charges from Mueller that relate to his work prior to joining Trump - left the campaign in August 2016 after reports about questionable payments he received from his work related to Ukraine.
Van der Zwaan then chose to "correct the record", and went back for another meeting with the special counsel's office on December 1.
"The conduct that brings Alex before this Court was inexcusable", the filing says. "And while his actions following his initial meeting with the [special counsel's office] can not absolve him from culpability, they are compelling mitigating factors in considering punishment".
