Trump DOJ and HHS Issue Major Religious Liberty, Pro-Life Protections

The Justice Department issued legal guidance across the federal government Friday that outlines how agencies should interpret religious freedom protections - a broad directive that supporters say allows individuals to live and work in a manner consistent with their religion.

The attorney general's memorandum includes protections under the Religious Freedom Restoration Act (RFRA), including (#14) how demanding its legal standard is in protecting religious liberty, (#12) that it does not allow the federal government "to second-guess the reasonableness of a religious belief", and (#13) RFRA is violated when the government "substantially pressures" a religious person or group "to modify such observance or practice".

According to the Associated Press, it will essentially lift a burden from religious objectors: A simple claim of a violation of religious freedom would be enough to outweigh possible civil rights violations, thus they'd no longer have to prove that their beliefs are sincerely held.

These broad protections have called into question whether the religious freedoms for some may impose discrimination on others such as the LGBT community and pro-choice advocates.

Among other thing, the guidance adopts certain aspects of the so-called First Amendment Defense Act (FADA)-a key legislative priority of the Religious Right- as administration policy.

ACLU has announced that it is suing the Trump administration to block the new rules allowing employers to deny insurance coverage for birth control.

"Religious liberty is not merely a right to personal religious beliefs or even to worship in a sacred place", he wrote.

"Today the Trump-Pence administration launched an all-out assault on LGBTQ people, women and other minority communities by unleashing a sweeping license to discriminate", said Griffin in a statement.

"It's time for Sessions to stop using the Justice Department as a tool for division and discrimination".

In crafting the policy guidance, the Department of Justice (DOJ) consulted extensively with "religious and political groups with a history of opposing protections for LGBT people", but not "specifically" with any LGBTQ rights organizations, Buzzfeed reported on Friday.

He additionally explained that the government can not compel a person or organization to act contrary to their religion, stating that "a government action that bans an aspect of an adherent's religious observance or practice, compels an act inconsistent with that observance or practice, will qualify as a substantial burden on the exercise of religion".

Generally, the federal government may not condition federal grants or contracts on the religious organization altering its religious character, beliefs, or activities.

"It opens the door for discrimination in the workplace and public services, flying in the face of the majority of Americans of whom over 70 percent believe laws should protect LGBTQ people from discrimination", Isaacs said.

"I support religious freedom and the freedom of full equality for every American", Baldwin said in a statement.

"Today's DOJ memo is a road map for federal agencies: guiding them to discriminate against women and LGBT people", Tiven said.

The freedom of religion is an important, fundamental right, expressly protected by federal law.

"This discrimination is not an American value". The U.S. Supreme Court recently agreed to review the Phillips case.

Additionally, in 2015 while Mike Pence was governor, in passed its own version of the Religious Freedom Restoration Act, despite outcry from opponents who argued the bill could be used to legally discriminate against LGBTI people. "A license to discriminate goes against our core American values and I fear that the guidance the Justice Department issued today is not created to help agencies comply with the law, but rather to give them greater leeway to condone discrimination against LGBTQ people, women and others". "This Department remains committed to protecting the civil and constitutional rights of all individuals, and will continue to enforce the numerous laws that Congress has enacted that prohibit discrimination on the basis of sexual orientation".
