George Conway, a lawyer who was until recently in the running to become Mr. Trump's pick to head the Civil Division for the Justice Department, then re-tweeted the president admonishingly.

In his early morning Twitter messages on Monday, Trump potentially hurt his administration's legal case as it seeks to have the Supreme Court overturn lower courts' rulings and allow the travel ban to go into effect.

White House aide Kellyanne Conway says the media is "obsessed" with President Trump tweets, which are likely the most accurate representation of his administration's view.

"These tweets may make some [people] feel better", Conway tweeted, "but they certainly won't help OSG get 5 votes in SCOTUS, which is what actually matters".

Neither Kellyanne nor George Conway, who reside in Alpine in Bergen County, responded to requests for comment by NJ Advance Media on Monday.

Aside from its seemingly mocking tone, George Conway's tweet offered a surprisingly frank assessment of the president's legal and communications strategy. He also said that "sensible" lawyers in the White House and Justice Department agree with him.

One of the reasons the court held up the order was because Trump regularly called for a ban on Muslims during the campaign, which would be a violation of the First Amendment. "The pt can not be stressed enough that tweets on legal matters. seriously undermine Admin agenda and POTUS-and those who support him, as I do, need to reinforce that pt and not be shy about it".

"I have reluctantly concluded, however, that, for me and my family, this is not the right time for me to leave the private sector and take on a new role in the federal government", Conway said in a statement at the time.

Spokeswoman Sarah Sanders says the president's power to invoke privilege is "well-established". But in doing so, they've tried to argue that this is a new policy and that its legality should be judged independently from the president's statements about older versions of the "ban".
